Welcome to Mindlume. By accessing or using our web application at app.mindlume.app and our website at mindlume.app (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1. Description of Service

Mindlume is an intelligent clinical documentation platform that assists licensed behavioral health providers in generating structured progress notes. The Service uses smart technology to transform clinician-selected inputs into professionally written clinical documentation in SOAP, DAP, and BIRP formats.

2. Eligibility

Mindlume is intended for use by licensed, credentialed, or supervised behavioral health professionals including but not limited to therapists, counselors, social workers, psychologists, peer support specialists, and case managers. By using the Service, you represent that you are a qualified behavioral health professional or are operating under appropriate clinical supervision.

3. Account Registration

To use Mindlume, you must create an account through our authentication provider. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

Mindlume is a documentation assistance tool, not a clinical decision-making tool.

5. Subscription and Billing

Free Tier: Includes a limited number of smart-generated notes per month at no cost. No credit card is required.

Paid Plans: Paid subscriptions are billed monthly or annually through Stripe. Prices are listed on our pricing page and are subject to change with advance notice. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial billing periods.

The Mindlume name, logo, brand assets, application code, compliance language libraries, and all associated content are the intellectual property of Mindlume and its founder. You may not copy, reproduce, or distribute any part of the Service without written permission.

Clinical notes generated through the Service are your property. You retain full ownership of all documentation you create using Mindlume.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Limitation of Liability

To the maximum extent permitted by law, Mindlume and its founder, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

Our total liability for any claims related to the Service shall not exceed the amount you paid to Mindlume in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Mindlume from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your failure to review and verify generated documentation before signing and filing.

11. Service Availability

We strive to maintain reliable access to Mindlume but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from service downtime.

12. Modifications to Terms

We reserve the right to update these Terms at any time. Material changes will be communicated to registered users via email. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

13. Termination

We may suspend or terminate your access to the Service if you violate these Terms, engage in fraudulent activity, or use the Service in a manner that could harm other users or the integrity of the platform. You may terminate your account at any time by contacting us.

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict of law principles.
